During a hearing in San Francisco, California District Judge James Donato raised concerns about a new agreement between Epic and Google that includes joint product development, marketing commitments, and partnerships.

Details of the deal were largely kept under wraps, but it was revealed that Epic would assist Google in marketing Android, while Google would utilize Epic’s core technology. Epic CEO Tim Sweeney hinted at the agreement’s focus on the “metaverse,” a concept encompassing Epic’s Fortnite game. Sweeney also mentioned the potential for Google to leverage the Unreal Engine for product development.

Judge Donato shed light on one aspect of the deal, mentioning an $800 million expenditure over six years by Epic for Google services. Sweeney clarified that the collaboration does not involve a joint new product but rather separate product lines developed by Google and Epic. Despite this, the partnership is viewed as a significant transfer of value from Epic to Google.

While Google declined to comment on the deal, Epic emphasized that the agreement is not a payoff to soften terms but a strategic move to foster competition. Sweeney reiterated Epic’s commitment to fair practices, stating that the Epic Games Store will not receive preferential treatment on Android as a result of the deal.

The settlement appears to be intertwined with the business agreement, with Judge Donato suggesting that the deal would only proceed if the settlement is finalized. Sweeney expressed confidence in reaching specific terms and highlighted the importance of the settlement and partnership in Epic’s future growth strategy.
