CCI Fights Back Against $38B Fine Threat

Indian regulators are gearing up to impose fines on Apple for alleged antitrust violations related to its App Store. However, Apple is challenging the potential fines imposed by the Competition Commission of India (CCI).

The CCI initiated an investigation into Apple’s App Store practices in response to a complaint from “Together We Fight Society” (TWFS), a charitable group advocating for public interest issues. The investigation also encompassed complaints from Tinder’s Match, several Indian startups, and the Alliance of Digital India Foundation, all asserting that Apple’s fees were detrimental to competition.

Following the investigation, which concluded in mid-2024 with a report stating that Apple wields significant influence over digital services and products and engages in abusive practices, the CCI has the authority to levy fines of up to 10% of Apple’s average global turnover over a three-year period. This could potentially result in a fine of $38 billion for Apple.

Apple has contested the CCI’s findings and is challenging Indian law to reduce the fines, arguing that they are disproportionate. The CCI, in response, maintains that the fines align with international competition law enforcement practices and are necessary to deter anticompetitive behavior.

The Indian government supports the CCI’s stance, emphasizing that fines based solely on turnover in the country may not be sufficient to deter future violations by Apple. While Apple claims that the CCI is seeking India-specific financial details for the investigation, the regulator asserts that Apple is attempting to mislead the court by downplaying the potential penalties.

The lengthy legal battle between Apple and the CCI has seen multiple challenges and delays, with Apple raising concerns about the disclosure of sensitive information and the calculation of fines based on global turnover. The case is set to be heard in the Delhi High Court on January 27, 2026, which will determine the final outcome and potential penalties for Apple.
