The legal dispute between Apple and Masimo regarding the blood oxygen sensor technology in the Apple Watch seems to have reached a conclusion, at least for now. US District Judge James V. Selna has denied Apple’s appeal of a jury’s decision, effectively ending the legal battle between the two companies.

Despite extensive media coverage and a substantial fine that Apple will have to pay to Masimo’s new owner Danaher, the outcome of the dispute remains somewhat unresolved. Masimo initially secured a ban on the import of Apple Watches with the blood oxygen sensor technology. However, Apple managed to develop a workaround that allowed them to use the sensor without infringing on Masimo’s patents, leading to the reactivation of the oxygen sensor in a software update.

Apple now faces the task of paying the damages awarded to Masimo, which amount to $634 million. While this sum may not significantly impact Apple’s finances, the company has indicated its intention to appeal the decision. Apple had argued for much lower damages, between $3 million and $6 million, but the final ruling went in favor of Masimo.

Despite the judge rejecting requests for a new judgment or trial, Apple may still explore legal options to challenge the ruling. The company has a team of skilled lawyers who specialize in finding legal loopholes and strategies to navigate complex legal situations.

In a related complaint before the US International Trade Commission (ITC), Masimo succeeded in obtaining a ban on importing and selling certain Apple Watch models in the US. However, Apple was able to restore the blood oxygen feature through a software update that bypassed Masimo’s patents. After some back-and-forth with CBP and legal challenges from Masimo, the ITC ultimately ruled in Apple’s favor, allowing the sale of Apple Watch models with the redesigned blood oxygen sensor technology to continue in the US.

The legal saga between Apple and Masimo has been marked by twists and turns, but it appears to have come to a definitive end with the ITC’s decision not to review any further petitions from Masimo. This outcome allows Apple to proceed with selling its updated Apple Watch models without further legal hindrances.
