Legal Battle: CXMT Challenges Pentagon’s Blacklisting Decision

Chinese memory manufacturer CXMT has entered the fray in the ongoing battle between Apple and the Pentagon over memory sourcing. The company has taken legal action against the Pentagon for placing it on a supplier blacklist, labeling it as a risky “Chinese military company.”

Apple has been facing challenges in sourcing memory and storage chips for its iPhone and Mac products due to tight supplies and high demand from the AI industry for data center memory. In an effort to address this issue, Apple sought permission from the Trump administration to purchase memory chips from CXMT, despite its blacklisted status.

CXMT has now filed a lawsuit against the Pentagon, arguing that it is not a military company and does not have any ties to the Chinese military. The company claims that it only provides chips for civilian and commercial purposes and that the Pentagon’s decision to blacklist it was arbitrary and lacked evidence.

Since January 2025, CXMT has been classified as a risk by the Pentagon, resulting in damage to its business and reputation. Despite briefly being removed from the blacklist in February 2026, the decision was later reversed without explanation.

The Pentagon has alleged that CXMT is affiliated with Chinese government entities, leading to concerns about national security risks. While the blacklist does not explicitly prohibit American companies like Apple from doing business with CXMT, there are potential consequences for disregarding the restrictions.

If Apple were to use CXMT memory in its devices without official approval, it could result in repercussions such as loss of sales to the US government. The situation has become a political issue in Washington, with lawmakers and industry executives weighing in on the implications of dealing with Chinese suppliers.

The uncertainty surrounding the outcome of this dispute underscores the complex dynamics at play in the tech industry. As the battle continues to unfold, the implications for both Apple and CXMT remain uncertain. The repercussions of this legal battle could have far-reaching consequences for the broader tech industry and US-China relations.
