Denuvo Takes Prolific Game Cracker to Court Over DMCA Violations

A prominent digital rights management software provider, Denuvo, has initiated legal action against an anonymous game cracker in the USA for allegedly violating the Digital Millennium Copyright Act. The cracker, known as “voices38,” is accused of circumventing anti-tamper technology on 26 games, including popular titles like Black Myth: Wukong, Resident Evil Requiem, and Doom: The Dark Ages.

On September 14th, Denuvo filed a DMCA complaint against voices38 in the US District Court for the Northern District of California. According to the filing obtained by Torrent Freak, Denuvo alleges that voices38 has unlawfully bypassed DRM restrictions on copyrighted works, enabling the distribution of pirated versions of these games.

Unlike traditional copyright infringement claims, Denuvo’s legal action is based on a section of US copyright law that prohibits the circumvention of digital locks on copyrighted works. The company is seeking damages and an injunction against the removal of anti-tamper software from any video game, past, present, or future.

One of the challenges Denuvo faces is the unknown identity of voices38. While they have identified a Discord ID, Reddit account, and several Steam profiles associated with the cracker, the defendant is referred to as “an unknown individual or entity,” along with 10 other unnamed defendants.

According to Torrent Freak, Denuvo’s legal action may involve requesting permission to subpoena Valve, Reddit, and Discord for additional information on voices38. If successful, the court case could serve as a deterrent to other crackers and facilitate the removal of download links for anti-tamper software.

Despite the legal proceedings, voices38 appears undeterred. A Reddit comment attributed to the cracker states, “All is fine. Everything will continue as normal.”

While voices38’s activities enable game piracy, the primary concern for many individuals is the impact of Denuvo’s anti-tamper protection on game performance. The software works by obfuscating and encrypting code, potentially affecting gameplay.

There is ongoing debate regarding the extent of the performance impact caused by Denuvo’s DRM. In response to criticism, Denuvo pledged to establish an independent testing initiative in 2023 to address concerns about frame-rate issues. However, the implementation of this initiative remains unclear.

Beyond performance issues, another objection to Denuvo DRM is its potential requirement for online checks to function properly, posing a threat to game preservation efforts.
