Legal Battle: Elon Musk Ordered to Release Emails in Apple Lawsuit Against Tesla and SpaceX
In a recent legal development, United States District Judge Mark Pittman has ruled against xAI’s attempt to exclude Elon Musk’s emails from Tesla and SpaceX from discovery in the ongoing lawsuit involving Apple and OpenAI. The decision sheds light on the details of the case.
Musk to Provide Additional Material for Discovery
During a hearing before United States Magistrate Judge Hal R. Ray, Jr., the legal teams of Apple, OpenAI, X, and xAI discussed various disputes related to the discovery process in Elon Musk’s lawsuit against Apple and OpenAI.
The lawsuit originated from Musk’s dissatisfaction with Grok’s rankings in the App Store, alleging anticompetitive collusion between Apple and OpenAI due to their collaboration in using ChatGPT for Siri and Apple Intelligence.
Judge Ray approved X and xAI’s request to involve Craig Federighi as a custodian and compel Apple to provide documents regarding its recent agreement with Google for Siri’s new functionality powered by Gemini.
Another significant decision was Judge Ray accepting OpenAI’s argument that Musk’s emails from Tesla and SpaceX should be searched for relevant information in the lawsuit.
Despite X and xAI’s initial claim that these documents were outside their control since they did not pertain directly to SpaceX or Tesla, Judge Ray disagreed, emphasizing Musk’s high-level roles in these companies as a compelling factor.
Subsequently, X and xAI’s legal teams filed an objection and a motion to pause the order, which was overruled by Judge Pittman, upholding Judge Ray’s findings and denying the motion to stay the decision.
Judge Pittman justified his ruling by stating that there were indications of Musk conducting business activities related to X and xAI through his SpaceX and Tesla email accounts, making the emails discoverable.
Furthermore, the record suggested that Musk used other email accounts for business purposes, such as xAI’s CFO sending updates to Musk’s SpaceX email address, reinforcing the need for discovery.
No specific deadline was set for the production of these emails, but during a hearing, X and xAI’s legal team expressed readiness to comply promptly if ordered to do so.
